1 November 2004

On September 16, 2004 a Senior was accused of having Refused to Obey a Security Officer.   He/She was found Guilty by a vote of 9 to 0.  

As a result, he/she was:

•  Placed on Conduct Probation for the remainder of the Academic Year and

•  Asked to write a Formal Letter of Apology to the Officer

On 1 September 2004 a Junior was accused of having Failed to Report an Accident to the Proper Authorities.   He/She was found Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 6 to 1 to 1 and of Violating the University's Policy on Alcohol by a vote of 8 to 0.

As a result, he/she was:

•  Assessed a First Strike

On 24 October 2004 a Sophomore was accused of throwing Water Balloons at Passersby.   He/She was found Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 7 to 0.

As a result, he/she was

•  Placed on Conduct Probation for the remainder of the Academic year;

•  Assessed 30 hours of Community Service;

Note: The Student Judicial Council will consider the Respondent Not Guilty upon the completion of the above sanctions.   Once he/she has completed the assigned Community Service hours and the period of Conduct Probation is over, the Council will expunge his/her record completely and consider him/her innocent of all charges.

On 1 December 2004 a Sophomore was accused of sending an email message containing content considered threatening by some members of the University Community.   He/She was found Not Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 5 to 4 to 1.

Note:   This decision was appealed to the University Board of Appeals.   The result of that appeal is below.

The complainant appealed a decision against an individual student on the grounds that the penalty was insufficient. The case involved conduct unbecoming of a Washington and Lee University student. 


Outcome: ruled in favor of the complainant sanctioned the student to conduct and social probation and 50 hours of community service.

A Senior was accused of Driving Under the Influence of Alcohol.   He/She was found to have been operating a motor vehicle in Lexington or Rockbridge County with a BAC .10.  

He/She was found Guilty of Driving Under the Influence of Alcohol by a vote of 7 to 0, Guilty of Violating the University's Policy on Alcohol by a vote of 7 to 0 and Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 7 to 0.

As a result, he/she was:

•  Placed on Social Probation for the remainder of Winter Term;

•  Placed on Conduct Probation until Graduation;

•  Assessed 75 hours of community service and

•  Assessed a First Strike (the $100 fine normally associated with a Strike was waived)

A Sophomore was accused of Drinking and Driving.   He/She was found to have been operating a motor vehicle in Lexington or Rockbridge County with a BAC of .05.  

He/She was found Not Guilty of Driving Under the Influence of Alcohol by a vote of 1 to 9, Guilty of Violating the University's Policy on Alcohol by a vote of 10 to 0, Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 7 to 1 to 2.

As a Result, he/she was

•  Assessed 20 hours of community service and

•  Assessed a First Strike (all sanctions normally associated with a First Strike except the Conduct Probation were waived.)

A Junior was accused of Drinking and Driving.   He/She was found to have been operating a motor vehicle in Lexington or Rockbridge County with a BAC of .10.  

He/She was found Guilty of Driving Under the Influence of Alcohol by a vote of 10 to 0, Guilty of Violating the University's Policy on Alcohol by a vote of 10 to 0, Guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 10 to 0.

In lieu of Suspension, he/she was:

•  Assessed a Strike;

•  Placed on Social Probation for the remainder of the Academic Year;

•  Placed on Conduct Probation until Graduation;

•  Assessed Community Service in the following manner (50 hours to be completed by the end of this Academic Year, 40 hours to be completed by the end of Fall Term of 2005, 40 hours to be completed by the end of Winter Term 2006 and 20 hours to be completed by the end of Spring Term 2006.

A Third Year Law Student was cited for Urinating in Public on September 25, 2004.

The Student Judicial Council found him/her guilty of Conduct Unbecoming a Washington and Lee Student by a vote of 8-1.

As a result, the Student Judicial Council:

  • Assessed him/her five (5) hours of community service to be completed by the end of the academic year.

A Freshman was arrested for being Drunk in Public and Obstruction of Justice.

The Student Judicial Council found him/her Guilty of:

  • Conduct Unbecoming a Washington and Lee Student by a vote of 9 - 0

As a result, the Student Judicial Council has, by a vote of 8-1:

  • Assessed him/her 50 hours of community service;
  • Placed him/her on Social Probation until 8:00 a.m. on November 5 th or until his/her community service hours are complete, whichever takes longer

Three Sophomores were found to possess marijuana.

The Student Judicial Council found each one Guilty of:

  • Violating the University Policy on Illegal Drugs/Controlled Substances by a vote of 6 - 2 - 1 and of
  • Conduct Unbecoming a Washington and Lee Student by a vote of 8 - 1.

The Student Judicial Council did not assess a first strike.

Instead, the Student Judicial Council has, by a vote of 6 - 3:

  • Assessed 20 hours of community service to be completed by the end of Fall Term and
  • Placed him/her on Conduct Probation for the remainder of the academic year.

A Junior was arrested for Driving Under the Influence of Alcohol on May 30, 2004.   He/She was initially stopped because his/her headlights were not on.   He/She was found to have a BAC of .14.

The Student Judicial Council found him/her Guilty of:

  • Driving Under the Influence of Alcohol by a vote of 8 - 0;
  • Violating the University Policy on Alcohol by a vote of 8 - 0;
  • Conduct Unbecoming a Washington and Lee Student by a vote of 6-1-1.

As a result, the Student Judicial Council has, by a vote of 7-1:

  • Assessed 100 hours of Community Service to be completed before graduation;
  • Placed him/her on Conduct Probation until graduation;
  • Placed him/her on Social Probation until the end of Fall Term;
  • Assessed him/her a first strike, waiving the education and counseling portions normally associated with such a sanction.

This decision was appealed by the University to the University Board of Appeals and the Student Judicial Council decision was upheld.

A Junior was arrested for Driving Under the Influence of Alcohol on January 14, 2004.   He/She was initially stopped for Running a Red-light.   He/She was found to have a BAC of .11.

The Student Judicial Council found him/her Guilty of:

  • Driving Under the Influence of Alcohol by a vote of 7 - 0
  • Violating the University Policy on Alcohol by a vote of 7 - 0
  • Conduct Unbecoming a Washington and Lee Student by a vote of 5 - 1 - 1

As a result, the Student Judicial Council has:

  • Assessed him/her a First Strike (the fine normally associated with a First Strike has been waived, the Educational and Counseling portions have not been);
  • Placed him/her on Conduct Probation for the entire 2004-2005 academic year;
  • Placed him/her on Social Probation for Fall Term, 2004 and
  • Assessed him 75 hours of Community Service OR 50 hours IF AT LEAST 10 hours are completed in a way associated with alcohol awareness education.

A Senior was arrested for Driving Under the Influence of Alcohol on May 9, 2004.   He/She was initially stopped because of an illegal U-turn.   He/She was found to have a BAC of .19 and to be driving with a restricted license.

The Student Judicial Council found him/her Guilty of:

  • Driving Under the Influence of Alcohol by a vote of 7 - 1 - 0
  • Violating the University Policy on Alcohol by a vote of 7 - 1 - 0
  • Conduct Unbecoming a Washington and Lee Student by a vote of 5 - 1 - 2

As a result, the Student Judicial Council has:

  • Recommended (through the Dean of Students) that the faculty hold his/her Diploma until the Board of Trustees next meets in October
  • Placed him/her on Social Probation through Graduation
  • Placed him/her on Conduct Probation through Graduation
  • Blocked him/her from Walking at Graduation
  • Assessed him/her 150 hours of community service
  • Assessed him/her a first strike

  • Driving Under the Influence of Alcohol by a vote of 10 - 0
  • Violating the University Policy on Alcohol by a vote of 10 - 0
  • Conduct Unbecoming a Washington and Lee Student by a vote of 10 -0

As a result, the Student Judicial Council has:

  • Recommended (through the Dean of Students) that the faculty hold his/her Diploma
  • Placed him/her on Social Probation through Graduation
  • Placed him/her on Conduct Probation through Graduation
  • Blocked him/her from Walking at Graduation

The Student Judicial Council found him/her Guilty of:

  • Violating the University Policy on Alcohol by a vote of 10 - 0

The Student Judicial Council found him/her Not Guilty of:

  • Conduct Unbecoming a Washington and Lee Student by a vote of 0 - 10

As a result, the Student Judicial Council has:

  • Assessed him/her a Second Strike
  • Placed him/her on Social Probation for the remainder of Spring Term
  • Placed him/her on Conduct Probation for the 2004-2005 academic year
  • Assessed him/her 60 hours of community service, 10 of which must be completed by the end of Spring Term
